ESTABLISHING FAIR MARKET VALUE

Establishing the fair market value of a truck, tractor, trailer, RV or item of farm equipment isn't as simple as evaluating an automobile. The primary reason for this is that comparable items are much more difficult to find. In addition, the market for such vehicles fluctuates according to economic conditions. In Florida, for instance, a poor growing season or a lack of funding for road construction projects can lower the value of tractors and specialty trailers by as much as twenty five percent in a matter of months. Fuel prices have an adverse effect on not only trucks but on recreational vehicles as well. In cases of bankruptcy or divorce, valuation hearings are held to determine fair market values of specialized vehicles. It is important that the appraiser and his report are found to be credible in the eyes of the court. For the expert that is hired to perform the evaluation, the weight of the evidence is impacted by even the most minor of errors or omissions. Valuation hearings rely on exhibits such as fair market value appraisals so it is critical that the expert's report is factual and complete. The expert should be able to give full and thorough answers to questions concerning the subject vehicles. When the magistrate, trustee or mediator can trust the data provided, favorable judgments will follow.
In most states, any appraiser who performs an appraisal for insurance purposes must be licensed as an independent adjuster or appraiser. This credential far outweighs any certification provided by private organizations. An appraiser with a license from any state holds a better credential than "certified" or other designations used by appraisers. Licensed professionals in every state are bound by regulations which must be adhered to in order to continue in business. Other certifications require only yearly dues be paid to be accredited. From a court's perspective, state licensure outweighs any other appraiser credentials.
