APPRAISING DONKS, BAGGED RIDES AND OTHER WHIPS IN FLORIDA

Appraising Donks in Florida

ORLANDO, Florida - As a wise sage at a recent custom car show said, "Florida got some clean whips." A "Whip" is slang for a car but here in The Sunshine State they've taken it way over the top. These boys and girls are representing Florida well with some fresh, clean customs. A "Donk," for anyone who isn't familiar with the term, is a 1971-1976 Chevrolet Caprice or Impala. They called it that because the owners at the time said the logo looked like a Donkey or Donk for short.  They get lifted, outfitted with huge wheels and stereo/I.C.E stystems and painted in colors and themes that can be described as everything from sick to sweet. A "Vert" is short for convertible. A "Bagged Ride" is basically a low-rider, often constructed using a Chevy S-10 body (known as a "bagged dime") but also with square Rangers, 88-98 Silverados and most Eurojap cars. Using air & nitrogen tanks, regulators and custom suspensions to raise and lower the vehicles, they are great at producing frightening, ground-scraping driving experiences. Insurance for these cars is available but coming up with legitimate fair market values for them is another matter. Often, between the lift kits, sound systems, interior customizations and motor work, a Donk or other high rise car or truck can easily have $150K invested in it. Clean whips, indeed. Many owners feel that their automobiles are worth every penny that was sunk into them but comparable sales show that lots of cars looking and sounding good don't bring half that amount.

Automobile Diminished Value

SARASOTA, Florida - The world of Automobile Diminished Value keeps getting bigger and bigger. Just a few scant years ago, long after CARFAX started providing vehicle history reports, insurance companies who were liable for paying these types of claims denied that diminished value even existed. The insurers' mission to keep insurance consumers in the dark regarding their rights to collect for a vehicle's loss of value after it is repaired continues to this day. Has your insurance agent ever mentioned it? I didn't think so. This article is about how you are being scammed and not just by one insurance company. Virtually all of them are doing it but some, evidently, are a lot worse than others.

A man called me from Sarasota, Florida to inquire about obtaining an Automobile Diminished Value report from St Lucie Appraisal. His car, a gorgeous 2011 Audi R8 with 4,500 miles for which he paid $168,000, was damaged by another car that happens to be insured by Travelers Insurance Company. For anyone who doesn't know the meaning of Automobile Diminished Value, here's the quick read. When a  car is repaired after an accident, it becomes a "dirty CARFAX car" that is worth less than a similar car that had never been in an accident. That loss of worth is known as "diminished value" and in Florida as well as most states; you are entitled to collect it from the responsible party's insurance company.

So how does one determine the amount of diminished value a vehicle has suffered? The most commonly used approach by insurance companies used to be establishing  formulas that assigned points based on the type of damage, air bag deployment, etc. but various state courts decided these methods resulted in artificially low values that were unfair to consumers. A second manner of determining diminished value, the one used by most independent appraisers, is to cull the numbers from auction results that show a rough idea of how much less money previously repaired vehicles sold for vs. similar non-accident cars. The problem with that practice is that it fails to address the specific subject vehicle and the exact nature of the repairs that were done. Many of these reports are severely downgraded by insurance adjusters for that very reason.

The St. Lucie Appraisal Company gathers its Automobile Diminished Value data directly from used car managers at auto dealerships. They are the only ones who can provide an accurate estimation of how much less they would pay for the car based on the circumstances involving that particular vehicle. In the case of the 2011 Audi R8, the low mileage, 5.2 Liter V-10 engine, six-speed transmission and even the color played into each dealer's opinion. The repaired damage was minimal, $4,500 in sheet metal repairs with no structural impairment. Everything was in place for them to provide an honest opinion of how much less they would pay for this dirty CARFAX Audi.

Our practice is to obtain six dealer quotes in order to provide fair conclusions that can't easily be refuted. At the end of the day, the six dealer opinions averaged out to a diminished value of $14,620.50 on the 2011 Audi. That figure represents how much less the vehicle is worth because it was previously repaired.

So when I first got the call, it was with keen interest that I listened to my client's story about how the adjuster from Traveler's Insurance Company in Tampa, Florida had contacted him with a settlement offer of $500.00. That is not a typo. Traveler's offered this man five hundred dollars for the diminished value on his vehicle. There are laws that make it a crime to fleece unsuspecting folks but apparently not when it comes to this activity. The lowest of my six dealer quotes was $10K and if the insurance adjuster had simply made a telephone query to any auto dealer it would have provided a similar result. But that's not the way it works with insurance companies.

So be aware. Knowledge is power. Do not accept an insurer's Automobile Diminished Value settlement offer without first obtaining an independent appraisal from a licensed appraiser. Because once you've signed and accepted the insurance company's offer, the door to your receiving a fair settlement is closed.

AUTOMOBILE DIMINISHED VALUE IN FLORIDA - DO ANTIQUE, CLASSIC AND CUSTOM CARS QUALIFY? JUST ASK THIS 1967 PLYMOUTH BARRACUDA.

A UNIQUE AUTOMOBILE DIMINISHED VALUE APPRAISAL 

GAINESVILLE, Florida - Automobile Diminished Value, as many Florida insurance consumers have learned, occurs the instant a late-model motor vehicle is involved in a collision and subsequently repaired. Regardless of how minor the damage was, and no matter that the body shop did a great job, because of the well known CARFAX vehicle history report, the car is now worth less. Come time to sell or trade-in your late-model car, prepare for the used car manager at the dealership to knock thousands of dollars from the fair market value. Vehicles most severely impacted are newer cars and, of course, high end vehicles like BMW, Mercedez-Benz, Porsche, Land Rover, etc. In Florida, we can recover that difference in value by filing an Automobile Diminished Value claim against the at-fault driver's insurance company along with an appraisal.  But antique cars aren't even included in the CARFAX database so how did a classic 1967 Plymouth Barracuda wind up in an Automobile Diminished Value dispute? Ever hear of a Mopar 340 motor?

For those in the know, the iconic Mopar 340 Cubic Inch racing engine wasn't available until 1968 but when it appeared on the track it took the racing world by storm. Over the years these motors were practically raced out of existence and now it is easier to find a rare 426 Cubic Inch motor than it is to obtain a fresh 340. It was with great anticipation that the man from Central Florida dropped his modified, factory-bored 340 engine into his 1967 Cuda. And it was enjoyable to feel the extra power as he drove the highways and back roads around Gainesville, Ocala and Palatka.

One day the man from Central Florida brought his car to a mechanic who, according to the vehicle owner, improperly repaired the 340 motor which ended up destroying the block. Since no like, kind and quality engine is available, his only recourse will be to use a different motor, either a bored out 318 or a 360 truck motor being the most likely candidates. After the job is done, will the 1967 Barracuda be worth as much as it was before? As it turns out, the answer is no.

"I think that putting a modified 318 in place of the 340 would probably reduce the value.  I'm a believer in building the 318 because these engines can deliver a lot of power for relatively low cost.  However, something about a 340 really turns people on psychologically.  So, therein lies the extra value."

That comment is typical of how a Mopar afficianado feels about the 340 motor. Here are the results of my Automobile Diminished Value report using a Fair Market Value of $25,000 provided by the vehicle owner.

DIMINISHED VALUE RESEARCH

I received this assignment to prepare a Diminished Value report on 08/09/2012. The above captioned vehicle was damaged in December 2010. It did sustain major engine damage According to the vehicle owner, a mechanic performed unauthorized and improper repairs to the motor that damaged it beyond repair or redemption. The car was equipped with a factory-bored 340 motor which is as rare as it is desirable. There is virtually no way to replace this motor and no other engine configuration would provide the same desirability as a fresh 340. There are 340s out there but none that wouldn’t require a trip to the machine shop which defeats the purpose. Due to the resultant damages and the unavailability of a like, kind and quality motor, there is a decrease in the vehicle’s Fair Market Value.

The Mopar 340 engine was an iconic high performance motor that has become more difficult to find with the passage of time. Mopar aficionados pay a premium for vehicles equipped with original factory-bored 340s regardless of whether it was original equipment or not.

One of the best engines of the 1960s and 1970s for performance enthusiasts was the 340 V-8. It had high-flow heads, big ports, a two-level intake manifold, and a six-barrel option (three two-barrel carbs). The package allowed for high speed with the light weight helping handling.

 ·        Brad of Mopar Dude Auto, Burlington, KS, 620-364-8200  stated that the Diminished Value would be negligible, in the 10% range. He said that one could find a 426 (extremely rare motor) before he would find a good 340.

·        Ramon of Ramon’s Mopar Cars & Parts, Burneyville, OK, 580-276-9958 stated that the engine difference does make a big difference which he estimates to be 25% of the value of the car.

·        Jim McGee of Mopar Alley, Kingsport, TN, 423-817-2839 stated that the dimunition of value as a result of the difference in engines is as much as 50% of the car’s value.

·        Jason Muckala of MOTECH Performance, Murrieta, CA, 951-813-3550 stated that there would be a 30% reduction in value because of the difference in engines.

·        Owd Kasd, Senior Member of For A Bodies Only Mopar Forum has stated that the diminished value as a result of the engine difference could be from 25%-50% which averages 37%. He went on to write that “The 340 has a lot of pull for buyers.”


Other comments:

Mopar410: I agree. Just the word 340 opens people’s eyes. When they hear 318 the first thought is “Oh, OK.” There is a stigma about small-block Mopars. The 340 was a performance engine (for good reason) and the 360 was just a truck motor. These views aren’t mine but what I have experienced thru the years.

273: You probably get around the same price but the 340 would make a quicker sale cause what would you rather have a 340 car or a 318 car?

Adam R: The 340 would be worth more because it’s a more "desirable" motor. How much more depends on the buyer.

The average of five (5) deductions is 30.00%. This is the percentage of Diminished Value to be taken from the FMV at the time of loss.

So after preparing hundreds of Automobile Diminished Value appraisals on late-model bad CARFAX cars and the aforementioned BMWs, Mercedes-Benz, Porsches and Land Rovers throughout Florida, I finally got a really cool assignment. The misdeeds of mechanics and a rarity of replacement parts contributed to a unique Diminished Value scenario involving a 1967 Plymouth Barracuda and the star of the show, a Mopar Factory-bored 340 Cubic Inch motor. So can there be cases of Automobile Diminished Value in antique, classic and custom cars? You bet.

SAVIOR OR ANTI-CHRIST? AN ARTICLE ABOUT CARFAX AND AUTOMOBILE DIMINISHED VALUE IN FLORIDA


AUTOMOBILE DIMINISHED VALUE IN FLORIDA 

JUPITER, Florida - Whenever I have a few hours to kill between automobile, truck and RV appraisals you'll find me introducing myself to all sorts of different people. From banks to insurance agents to truck repairers to RV dealers to auto body shops, my audience of potential customers is practically limitless and I'm not shy about dropping in to say hello. Rather than trying to sell someone on my services, my approach is a simple introduction and declaration that I'm leaving them with a few St. Lucie Appraisal business cards. Sometimes a conversation ensues but more often than not I'm in and out pretty quickly. There are, however, instances that cause me to step back a few paces. My visit to Schmidt's Auto Body in Jupiter, Florida provided me with one such occasion and it was a doozy! It began with  a discussion about Automobile Diminished Value in Florida and ended with the shop owner calling me "the anti-Christ." Say what?

For readers who aren't aware of Automobile Diminished Value in Florida, when your late-model car is repaired after being damaged in a collision, a CARFAX history report becomes a permanent part of the vehicle. The fact that the vehicle was previously repaired makes it inherently less desireable than a similar car that was never damaged. Consequently, when you trade your car in and the dirty CARFAX is discovered, your new car dealer will naturally offer you less than the trade-in value. He has to do it because your vehicle, unfortunately, is now less desirable to his customers. Most used-car buyers, naturally, prefer cars that were never in accidents. This difference essentially represents your Automobile Diminished Value and it can reach the tens of thousands of dollars.

In Florida, if the accident was caused by the other driver, you can make a claim against their insurance company for that difference. This privelege is written into all insurance policies, their guarantee to indemnify their policyholder. I can understand why Allstate, Geico, Progressive and the rest of the insurors aren't too thrilled with how Florida's courts have upheld Automobile Diminished Value as a basic right. But a body shop guy?

The owner of Schmidt's Auto Body of Jupiter, Florida doesn't believe in Automobile Diminished Value. His very loud opinion was that everyone involved in it, from the scummy car dealers to the appraiser trying to obtain compensation for the car owner right down to the poor guy whose 2012 Lexus was rear-ended are the lowest of the low. He didn't, of course, offer any solution or other enlightenment. Let the vehicle owner be the one to absorb the financial hit seemed to be his message. So after his little diatribe, a suggestion where I could stick my business card and a new name for me - the "anti-Christ" - I backed out of there quickly.

The name of his town is Jupiter and even though I know that it's not THAT Jupiter, somehow, after leaving Schmidt's, I began to get the feeling I actually was on another planet.

DARRELL GWYNN AND KENNY BERNSTEIN - TWO NHRA GREATS STILL GIVING THEIR ALL FOR THOSE IN NEED

DAVIE, Florida - Darrell Gwynn is a good guy. After contacting me last month to inquire whether St Lucie Appraisal would be interested in appraising NHRA great Kenny Bernstein’s entire automobile racing and memorabilia collection – most of it autographed - we have become good friends.

Entering the Darrell Gwynn Foundation’s facility in South Florida is like being among family. For anyone not familiar with Darrell, he currently operates his non-profit charity to help support people with paralysis and prevent spinal cord injuries. Most notably, the foundation operates a national Wheelchair Donation Program which donates custom power wheelchairs to individuals facing medical and financial hardships.

Darrell’s former pursuit was driving top-fuel dragsters for a living. Like Kenny, one of his cars bore the Budweiser insignia. He was born into the sport as his dad Jerry Gwynn was a hot-shot driver himself with many trophies and old automobile race car photos on his office walls to prove it. In fact, every hallway at the Darrell Gwynn Foundation is lined with memorable automobile racing photos, articles and collectible posters bringing you back to the eras during which the dangerous sport was born.

On Easter Sunday 1990, at Santa Pod Raceway in Northamptonshire, England, Darrell was in a violent crash and fiery explosion that almost took his life. Everyone involved with automobile racing knows Darrell Gwynn’s name. Most of all, people I talk to express shock that he lived through that crash. But Darrell Gwynn has a huge heart which helped him to survive and now, although paralyzed himself, gives all of his strength and his resources to others who have suffered paralysis from spinal cord injuries by providing them with power wheelchairs which can cost up to $30,000.

Kenny Bernstein also drove dragsters and was sponsored by Anheuser Busch. Known for being the first to break the 300 MPH barrier which he did at Gainesville in 1992, he reminisced about Darrell. “Our relationship with Darrell and his family goes back decades,” said Bernstein. “We knew him as a teenager and remember him as our tall, lanky, mischievous Budweiser Top Fuel teammate in 1987 and 1988 when we were driving the Budweiser King Funny Car.”

Kenny’s generosity in donating his massive collection extends even further as he has made it known that his autograph-signing days are over, effectively making these the last items showcasing a world-class automobile racing career available to collectors and racing fans.

I had a blast appraising all of this stuff with the help of Darrell’s executive assistant Danielle, office manager Julie Gonzalez and NHRA aficionado Mike Goydos who flew down from Pennsylvania to lend a hand. It was fun not only because of its uniqueness but the sheer vastness of the collection and the amount of research required to properly appraise it allowed me to become intimate with an entire sport. It was my privilege to take a stroll down NHRA’s memory lane and meet this wonderful man and his family who have turned tragedy into triumph for the injured and for those in desperate need of wheelchairs.

One day, all of Kenny Bernstein’s funny car bodies, helmets, team shirts, photos, posters, trophies, tool boxes, furniture and other cool stuff will have been sold to collectors but the Darrell Gwynn Foundation will continue to sell donated cars and other automobile related items to provide for those in need.

CAR OWNERS IN FLORIDA CAN RECOVER THEIR AUTOMOBILE DIMINISHED VALUE 

FORT PIERCE, Florida - What do you suppose is the most closely-kept secret in Florida? So guarded and hush-hush, that there are no articles in newspapers about it nor can one find a reference to it in any library. It is a basic right afforded to all insurance consumers yet insurance companies would rather not share the information. And the most amazing thing isn't that the general public has been kept in the dark - that's probably to be expected - it's that most of  the people directly affected by it haven't a clue themselves. The secret is called "Automobile Diminished Value" and what it means is that Floridians whose cars have been repaired after collision accidents can recover all or part of their vehicle's resultant loss in value from the at-fault driver's insurance company. A bad CARFAX means, when it comes time to trade-in or sell your car, you'll find that it's worth thousands less than fair market value - sometimes tens of thousands less. If the accident was your fault, you may deduct a portion of the car's loss in value from your federal income tax. Not only don't you know about Automobile Diminished Value, half of Florida's insurance agents and brokers either don't know or pretend not to know themselves. The biggest surprise is that many used car managers at Florida's car dealerships - the one's you'll most likely hear the "bad carfax = bad news" from - seldom let their disappointed customers know that there is hope for them. After all, many potential new car buyers, after learning their trade-in is worth thousands less, decide to keep their cars, ultimately costing that dealership a sale.

Just FYI:  I settled with Progressive for about $3700.  It took a little talking, since they started with a low ball offer of 2K, but I assured them I would be happy to take up their time in small claims court.  I decided not to go for a whole lot more, since I received a couple of comparison estimates from one of the online "diminished value specialists" of anywhere from 2K to 3.5K.  The body shop (Collision Professionals) ball park was about 3K. 
I think it helped that you were local, and had local used car dealer  confirmations.  I think that if I had "adjusted" your appraisal I might have gotten a few dollars more, but that would not have been honest or fair to you and your efforts. 

Bottom line, I think I was made pretty much whole in the deal, even though it stinks to have a new car hit.  By the way, I can also recommend the "Collision Professionals" as a body shop that does nice work, and seems to take pride in their product. 
Just as I said, I would complete the Angie's list evaluation, and you can use me as a reference if the occasion comes up. Please feel free to publish the letter in your blog.  I have found that few people know about the "Diminished Value" aspect of auto accidents.  While not everyone's case is amenable to a settlement, certainly many are, and those people should be compensated.
